By accessing, browsing, registering on, submitting a property listing to, or purchasing advertising services through the Bathamaga Property platform, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions.
If you do not agree with these Terms and Conditions, you must not use the platform or purchase advertising services.

Bathamaga Property provides a platform through which property owners, landlords, estate agents and other authorised advertisers can advertise properties available for rental or sale.
Bathamaga Property is an advertising platform only.
Our service is limited to providing advertising and marketing exposure for properties submitted by advertisers.
Bathamaga Property does not:
Any rental or sale transaction arising from an advertisement is conducted directly between the advertiser and the prospective tenant or buyer.
Advertisers may include property owners, landlords, estate agents and other persons or businesses legally authorised to advertise a property.
By submitting a property for advertising, the advertiser confirms that:
Bathamaga Property reserves the right to request proof of ownership, authority to advertise, identity or other information where reasonably necessary to verify a listing.
Advertisers are responsible for the content and accuracy of their property listings.
Listings must not contain:
Bathamaga Property may review, edit, reject, suspend or remove a listing where it reasonably believes that the listing breaches these Terms and Conditions, applicable law, or the interests and safety of users.
Removal of a listing does not relieve the advertiser of any obligations arising from these Terms and Conditions.
Advertising services are provided in accordance with the advertising package and price selected by the advertiser at the time of purchase.
Unless otherwise expressly stated, advertising fees are payable in full before the relevant advertising service is provided.
Bathamaga Property reserves the right to change its advertising prices and packages from time to time. Any price applicable to an existing paid advertising service will remain subject to the terms applicable at the time of purchase.
All prices displayed on the platform will be stated in South African Rand (ZAR).
Payments must be made using the payment methods made available by Bathamaga Property.
An advertising service will generally only commence once payment has been successfully received and verified.
Bathamaga Property is not responsible for delays caused by banks, payment processors or other third-party payment providers.
Where a payment is unsuccessful, reversed, disputed or dishonoured, Bathamaga Property may suspend or withhold the related advertising service until the payment issue has been resolved.
Advertising services are purchased for the publication and/or promotion of a property advertisement.
Because advertising space, advertising exposure and related services may be allocated or commenced following payment, advertising fees are generally non-refundable once the advertising service has commenced.
Bathamaga Property does not guarantee that an advertiser will receive enquiries, a tenant, a buyer, a lease, a sale or any particular financial result from an advertisement.
Nothing in these Terms and Conditions is intended to exclude or limit any right or remedy that cannot lawfully be excluded or limited under applicable South African law.
Where a refund is legally required or Bathamaga Property determines that a refund is appropriate, the refund will be processed in accordance with the applicable circumstances and law.
Bathamaga Property provides advertising exposure only.
Payment for an advertisement does not guarantee:
The performance of an advertisement may depend on factors outside Bathamaga Property‘s control, including property location, price, demand, market conditions, presentation and advertiser responsiveness.
All enquiries, negotiations, viewings, inspections, applications, screening, contractual arrangements, payments and other dealings relating to a property are between the advertiser and the prospective tenant or buyer.
Bathamaga Property is not a party to those dealings.
Users should independently verify the identity of the advertiser, the existence of the property, ownership or authority to let or sell the property, and all relevant terms before making any payment or entering into an agreement.
Bathamaga Property does not guarantee the identity, credibility, financial position, ownership status or conduct of any advertiser, tenant or buyer.
Bathamaga Property takes fraudulent property advertising seriously.
Users are encouraged to report suspicious, fraudulent or misleading listings to Bathamaga Property as soon as possible.
Bathamaga Property may suspend or remove a listing while investigating a complaint or suspected breach.
Where appropriate, Bathamaga Property may cooperate with law-enforcement authorities or other competent authorities in relation to suspected unlawful activity.
Bathamaga Property does not guarantee that every fraudulent listing or unlawful activity will be detected before publication.

Estate agents, property practitioners and other regulated advertisers are responsible for ensuring that they comply with all regulatory requirements applicable to them.
Nothing on the Bathamaga Property platform removes or replaces any legal, regulatory, licensing or professional obligation applicable to an advertiser.
Advertisers must not use Bathamaga Property to circumvent any legal or regulatory requirement applicable to their activities.
By submitting photographs, descriptions, logos, videos, trademarks or other material for publication, the advertiser confirms that they have the necessary rights or permission to use that material.
The advertiser grants Bathamaga Property a non-exclusive permission to use, reproduce, display, format, resize, edit for technical purposes and distribute the submitted material for the purpose of providing, marketing and promoting the relevant advertising service.
The advertiser remains responsible for ensuring that submitted material does not infringe the intellectual-property, privacy or other rights of another person.
Unless otherwise stated, the Bathamaga Property name, logo, branding, website design, original content, graphics, text, software and other materials belonging to Bathamaga Property remain the property of Bathamaga Legacy (Pty) Ltd or its relevant licensors.
Users may not reproduce, copy, modify, distribute, sell or commercially exploit Bathamaga Property‘s proprietary material without prior written permission.
Bathamaga Property will make reasonable efforts to keep the website and advertising platform operational.
However, uninterrupted availability cannot be guaranteed.
